1. Introduction
These Terms of Service ("Terms") govern all photographic services provided by Creative Link Inc ("Photographer", "we", "us", "our") to the Client ("you", "your") unless otherwise stated in a separate written agreement. By engaging our services, you agree to be bound by these Terms.
2. Services
We provide professional photography services as described on our website or in our promotional materials. Specific details such as scope, location, and duration of the photography services will be outlined in a separate project-specific contract.
3. Booking and Cancellation
A non-refundable booking fee is generally required to secure the date and time of your session, unless otherwise specified in your contract. This fee will be detailed in the project-specific contract. If you need to reschedule or cancel your booking, please notify us at least 2 days in advance. Failure to provide timely notice may result in forfeiture of your booking fee.
4. Payments
Payment terms will be specified in the project-specific contract. Generally, a percentage of the total fee is required at the time of booking, with the balance due on or before the day of the shoot. Late payments may incur late fees and potential disruption of delivery of final images.
5. Delivery of Photographs
We will deliver photographs in the format and within the timeframe specified in the project-specific contract. We strive to ensure timely delivery but are not responsible for delays outside of our control.
6. Copyright and Usage Rights
Unless otherwise agreed in writing, the copyright of all images remains with the Photographer. You will receive a license to use the images for personal or commercial purposes as agreed in the project-specific contract. Redistribution or resale of photographs without express written permission is prohibited.
7. Client Responsibilities
You agree to cooperate and follow the Photographer's directions during sessions to ensure the best results. You are responsible for obtaining any necessary permits and for ensuring that locations are safe for photography.
8. Limitation of Liability
The Photographer's liability for any claim, breach, or damage by fault or non-performance shall be limited to the payment received for the service provided. We are not liable for any indirect, special, or consequential loss.
9. Indemnification
You agree to indemnify and hold harmless the Photographer against any and all claims, costs, damages, and expenses arising from misuse of any images or breach of these Terms.
10. Privacy
We respect your privacy and commit to securely handling your personal data. Information collected will be used solely for the purpose of providing and promoting our services.
11. Modifications to These Terms
We reserve the right to modify these Terms at any time. Updated terms will not retroactively affect agreed contractual terms but will apply to future engagements.
12. Governing Law
These Terms shall be governed by the laws of Colorado. Any disputes arising under these Terms shall be resolved in the local courts of Colorado.
